1. Agreement to Terms

By accessing and using the Bright IT Solutions website and services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Bright IT Solutions, governed by the laws of the Federal Democratic Republic of Ethiopia. If you do not agree to these terms, please do not use our services.

3. Services

Bright IT Solutions provides cloud hosting, managed IT support, cybersecurity, web design and development, SEO, AI marketing, email solutions, and related digital services. Specific service terms, including service level agreements (SLAs), are detailed in individual service contracts provided upon engagement.

4. Account Registration

To access certain services, you may be required to create an account. You are responsible for: • Providing accurate and complete registration information • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorised use

5. Payment Terms

• All prices are quoted in Ethiopian Birr (ETB) unless otherwise stated • Value Added Tax (VAT) at 15% is applied where applicable • Payment methods accepted: bank transfer, Telebirr, CBE Birr, and international cards • Invoices are due within 30 days of issue unless otherwise agreed • Late payments may incur interest at the rate permitted by Ethiopian law • We reserve the right to suspend services for overdue accounts after 14 days' written notice

6. Service Level & Uptime

• Cloud hosting services carry a 99.9% uptime guarantee as detailed in our SLA • Scheduled maintenance windows are communicated at least 48 hours in advance • Credits for downtime exceeding SLA commitments are calculated as specified in your service agreement • Force majeure events (including but not limited to power outages, telecommunications failures, and government actions) are excluded from uptime calculations

7. Acceptable Use

You agree not to use our services to: • Violate any Ethiopian or international law or regulation • Distribute malware, spam, or malicious content • Infringe intellectual property rights of others • Host content that is defamatory, obscene, or promotes violence • Attempt to gain unauthorised access to our systems or networks • Use services for cryptocurrency mining without express written permission • Resell services without a white-label agreement Violation of these terms may result in immediate suspension or termination of services.

8. Intellectual Property

• Bright IT Solutions retains ownership of all proprietary tools, code, and methodologies • Custom work product created specifically for a client is transferred upon full payment as specified in the project contract • You grant us a limited licence to display your logo and company name in our client portfolio unless you opt out in writing

9. Data Protection

We process personal data in accordance with the Ethiopian Personal Data Protection Proclamation No. 1321/2024 and our Privacy Policy. By using our services, you acknowledge and agree to our data processing practices as described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by Ethiopian law: • Our total liability for any claim shall not exceed the total fees paid by you in the 12 months preceding the claim • We are not liable for indirect, incidental, or consequential damages, including lost profits or data • We are not liable for damages arising from force majeure events • Clients are responsible for maintaining their own backups unless backup services are included in their plan

11. Termination & Cancellation

• Monthly services may be cancelled with 30 days' written notice • Annual contracts may be cancelled at renewal with 60 days' notice • We may terminate services immediately for breach of these terms • Upon termination, we will provide a reasonable period (minimum 30 days) to retrieve your data • Refunds are provided on a pro-rata basis for prepaid annual services, less any setup fees

12. Consumer Protection

In accordance with the Ethiopian Trade Competition and Consumer Protection Proclamation: • All pricing is transparent with no hidden fees • Service descriptions accurately represent what is delivered • You have the right to a cooling-off period of 7 business days for new service agreements • Complaints can be directed to our customer service team or escalated to the Ethiopian Trade Competition and Consumer Protection Authority

13. Dispute Resolution

• Disputes shall first be resolved through good-faith negotiation between the parties • If negotiation fails, disputes shall be submitted to mediation in Addis Ababa • If mediation fails, disputes shall be resolved by the competent courts of Ethiopia in Addis Ababa • The governing law for all disputes is the law of the Federal Democratic Republic of Ethiopia

14. Modifications

We reserve the right to modify these Terms of Service. Material changes will be communicated via email and posted on this page at least 30 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
